Overview

Welcome to Big History! The terms "we", "us" and "our" refer to Big History. Big History operates this store and website, including all related information, content, features, tools, Big & Tall clothing, apparel, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Big History is powered by Shopify. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.

Section 1 — Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You are responsible for maintaining the security of your account credentials and for all account activity.

Section 2 — Our Products

We strive to provide an accurate representation of our Big & Tall apparel online. Colors, fit, and product appearance may differ from how they appear on your screen due to your device and settings. Sizing information is provided as a guide; fit may vary by body type. We do not warrant that any product will meet every expectation. We reserve the right to discontinue any product and limit quantities.

Section 3 — Orders

When you place an order, you are making an offer to purchase. Big History reserves the right to accept or decline your order. Your order is not accepted until we confirm acceptance. Purchases are subject to return or exchange solely in accordance with our Refund Policy.

Pre-Orders

Certain products are offered on a pre-order basis and are made to order after your purchase. When you place a pre-order, you authorize us to charge your payment method and agree that fulfillment—including production and preparation for shipment—may take up to 8 weeks (60 calendar days) from the order date.

You may cancel a pre-order within 24 hours of placing your order by contacting us at bighistory.shop@protonmail.com. Once production has begun, cancellation is not possible.

After your order ships and you receive your item, standard return and refund terms in our Refund Policy apply.

Pre-order timelines are estimates. We are not liable for reasonable production delays caused by materials, manufacturing, logistics, or events outside our reasonable control, but we will communicate material delays when practicable.

Title and risk of loss pass to you upon delivery to the carrier unless otherwise required by law. Pre-order terms supplement, and do not replace, our Shipping and Refund policies.

Section 4 — Prices and Billing

Prices, discounts and promotions are subject to change without notice. Posted prices do not include taxes or shipping unless stated. Free shipping on orders over $70 applies where offered at checkout. You agree to provide current, complete and accurate purchase and payment information.

Section 5 — Shipping and Delivery

See our Shipping Policy. We are not liable for shipping delays. Delivery times are estimates only. Once we transfer products to the carrier, title and risk of loss may pass to you as permitted by law.

Section 6 — Intellectual Property

Our Services, including trademarks, content, images, and design, are owned by Big History or licensors and protected by intellectual property laws. You may not reproduce or exploit any material without our prior written consent.

Section 7 — Optional Tools

Third-party tools may be offered through the Services "as is" without warranties. Use at your own risk.

Section 8 — Third-Party Links

We are not responsible for third-party websites linked from the Services. Review their policies before engaging.

Section 9 — Relationship with Shopify

Big History is powered by Shopify. Sales are made directly with Big History, not Shopify. You acknowledge Shopify is not responsible for products purchased from Big History.

Section 10 — Privacy Policy

Personal information is subject to our Privacy Policy and Shopify's privacy practices where applicable.

Section 11 — Feedback

If you submit feedback or reviews, you grant us a license to use them as described in these Terms. You represent your feedback is lawful and accurate.

Section 12 — Errors

We reserve the right to correct errors in pricing, descriptions, or availability and to cancel orders if information was inaccurate.

Section 13 — Prohibited Uses

You may not use the Services for unlawful purposes, to infringe rights, transmit malware, spam, scrape data, or interfere with security. We may suspend access for violations.

Section 14 — Termination

We may terminate access at any time. Surviving provisions include intellectual property, disclaimers, limitation of liability, and indemnification.

Section 15 — Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Section 16 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BIG HISTORY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS.

Section 17 — Indemnification

You agree to indemnify Big History and Shopify from claims arising from your breach of these Terms, violation of law, or use of the Services.

Section 18–20 — Severability; Waiver; Assignment

If any provision is unenforceable, the remainder stays in effect. Failure to enforce a right is not a waiver. We may assign these Terms; you may not without consent.

Section 21 — Governing Law

These Terms are governed by the laws applicable in England and Wales, with venue in courts having jurisdiction over Big History's headquarters in the United Kingdom, unless otherwise required by mandatory consumer law in your country.

Section 22–23 — Headings; Changes

Headings are for convenience only. We may update these Terms by posting changes on this page. Continued use constitutes acceptance.
